Rental Terms Summary
Effective date: [to be set at launch]
This is a plain-language summary of the agreement you accept when you rent or buy equipment from Hardwick Labs LLC, doing business as Homeward Recovery Co.. The full rental agreement is provided before delivery. If the two differ, the signed agreement controls.
1. Rental periods and pricing
- Rentals are priced by the week or by the month. A month means 4 weeks (28 days).
- The rental starts on the delivery date and continues week to week or month to month until we pick up the equipment.
- The Knee & Hip Homecoming Kit is $599 for the first 4 weeks. After that, the rented pieces continue at $99 per week or $349 per month.
- Prices are listed on our website and confirmed in writing before delivery. Sales tax is added where it applies.
- Product images on our website are representative. The equipment delivered may differ in make, model and color, but will be the same type of equipment with the features described.
- All equipment we rent and sell is non-prescription.
- We are private pay only and do not bill insurance or Medicare.
2. Payment and deposit
- The first rental period and any delivery fee are paid before delivery.
- A refundable deposit of $200 is held on your card. It is not charged unless there is damage, loss or unpaid rent, and it is released after pickup once the equipment is checked.
- Extensions are charged to the card on file at the start of each new rental period.[Confirm auto-renew wording and notice requirements under California law.]
3. Delivery, setup and pickup
- One delivery fee covers delivery, setup and pickup: $95 for an order that includes a recliner, $49 for smaller items, and included with the Homecoming Kit.
- Deliveries are booked at least 3 days ahead.
- An adult must be present at delivery and pickup and must give us safe access to the home, including information about stairs, gates and parking.
- Rescheduling: [notice required and any fee for rescheduling or a missed appointment].
- Cancellation before delivery: [refund policy, e.g. full refund with 24 hours' notice].
4. Using the equipment
- Use the equipment only for its intended purpose, at the home address where we delivered it, and indoors unless designed for outdoor use.
- Follow the manufacturer's instructions and the walkthrough we give at delivery, including weight limits.
- Don't move a lift recliner to another room or address, take equipment apart, or let anyone else repair it. Call us instead.
- Keep equipment clean and dry, away from pets, smoking and open flames.
- Whether a piece of equipment is right for a person is a decision for their care team. We provide equipment and logistics, not medical advice.
5. Repairs, damage and loss
- If equipment stops working through normal use, call us. We will repair or replace it at no charge.
- You are responsible for damage beyond normal wear and tear, and for loss or theft while the equipment is in your care. We will talk with you before charging any amount against the deposit.[Charges above the deposit and how they are calculated.]
6. Returns and early pickup
- Call or text to schedule pickup any time. No new rental period is charged after pickup.
- Weekly rentals are billed by the week and are not prorated by the day. [Confirm.]
- If equipment can't be picked up as scheduled, rent continues until it is.
7. Items you buy
- Raised toilet seats, shower chairs, transfer benches and hip kits are sold new and are yours to keep.
- Returns of purchased items: [policy, e.g. unopened items within 14 days; opened bathroom items are final sale for hygiene].
8. Cleaning
Every rental is cleaned, disinfected and inspected before delivery and checked again at setup.
9. Responsibility and safety
[Assumption of risk, limitation of liability and indemnity wording to be drafted by the attorney. Must comply with California consumer protection law and cannot limit liability for our own negligence where the law doesn't allow it.]
